论坛预告 | 佘山国际法律云裳视频论坛第二期

2020年4月28日，《视听表演北京条约》正式生效。《视听表演北京条约》（《北京条约》）是世界知识产权领域一个重要的里程碑，这也是新中国历史上第一个以我国城市命名的国际条约。《北京条约》为表演者权的保护提供了崭新的国际范本，有利于完善中国的著作权法律制度，提高中国表演者的权利保护水平，推动中国传统文化“走出去”。该条约有三个亮点：第一，解决了人们“看”的知识产权问题，过去是涉及“听”的权利；第二，考虑到了表演的复杂性，旨在解决有著作表演的著作人、电影电视的制片人、舞台剧的剧组等各方之间的复杂关系；第三，条约里界定了《北京条约》和国际上已经形成的六大条约的关系。

为深入解读《北京条约》，以期为知识产权领域律师、法官、学者及演艺界人士等提供学术研究和实务上的参考指引，由上海政法学院主办，上海政法学院国际法学院、上海邦信阳中建中汇律师事务所承办，上海市法学会“一带一路”法律研究会、华东政法大学知识产权法律与政策研究院共同协办的佘山国际法律云裳视频论坛第二期——“《北京条约》与国际知识产权法的发展趋势”主题论坛即将开启。本期论坛诚挚邀请参与条约制定谈判的WIPO官员、中方代表、美方代表、国家版权局专家以及海外知识产权领域知名学者和律师作为主讲嘉宾，共同在线探讨条约相关内容，并就该条约对文创行业发展带来的影响分享真知灼见。

王迁

Qian WANG

王迁，华东政法大学教授、博士生导师、校学术委员会副主任委员。兼任中国版权协会副理事长、中国版权保护中心首席研究员和中国知识产权法学研究会常务理事。是北京市高级人民法院、上海市检察院和上海知识产权法院等多家法院和检察院的咨询专家。获得国务院政府特殊津贴，获评“全国知识产权保护最具影响力人物”、“中国版权卓越成就者”和上海市五一劳动奖章。担任两项国家社科基金重大项目的首席专家。出版《版权法对技术措施的保护与规制研究》、《网络环境中的著作权保护研究》等专著，在《法学研究》、《中国法学》等期刊上发表学术论文和评论百余篇。在世界知识产权组织2012年缔结《视听表演北京条约》和2013年缔结《马拉喀什条约》的外交会议中，任中国代表团成员和“起草委员会”成员。

邓玉华

Yuhua DENG

邓玉华，世界知识产权组织中国办事处顾问。北京语言大学文学学士，中国人民大学新闻传播学文学硕士，英国玛丽女王学院知识产权管理科学硕士。国家知识产权专家库专家。曾长期在中国国家新闻出版广电总局、国家新闻出版总署（国家版权局）工作，历任中国国家新闻出版广电总局、国家新闻出版总署（国家版权局）版权管理司法律处副处长和国际处处长，负责版权国际应对和国际交流合作工作。2016年7月加入世界知识产权组织。

Ms. Deng Yuhua, Counsellor of the World Intellectual Property Organization Officein China (WOC). Ms. Deng had graduated from the Beijing Language and CultureUniversity with a Bachelor's Degree, been granted a Master Degree of Journalismand Communication from the Renmin University, and she had obtained a MasterDegree of IP Management from the Queen Mary College of the United Kingdom. Sheis the expert listed in the National Intellectual Property Expert Database. Shehad been working for more than 20 years in the National Copyright Administrationof China (NCAC) and was the Director of the International Affairs Division ofthe Copyright Department of NCAC, responsible for international negotiation,exchanges and cooperation of copyright in China. Ms. Deng joined the World IntellectualProperty Organization (WIPO) since July, 2016.

Justin HUGHES

Justin Hughes is the Hon. William Matthew Byrne Distinguished Professor of Law atLoyola Marymount University, where he teaches international trade and intellectual property courses. He previously taught at Cardozo Law School in New York.

From 2009 until 2013, Professor Hughes also served as Senior Advisor to the Under secretary of Commerce for Intellectual Property. In that capacity, he was the US chief negotiator for two multilateral treaties, theBeijing Treaty on Audiovisual Performances (2012) and the Marrakesh Treaty forthe Blind (2013).

Educated at Oberlin and Harvard, Professor Hughes practiced international arbitration in Paris and, as a Henry Luce Scholar, clerked for the Lord President of the Supreme Court of Malaysia. From 2006-2009, he was Chairman of the Technicolor/Thomson Foundation for Film and Television Heritage. Professor Hughes has also done volunteer democracy development work in Albania, Bosnia, El Salvador, Haiti, and Mali.

Althaf MARSOOF

Althaf Marsoof joined the Division of Business Law of the Nanyang Business School (NBS) as an Assistant Professor in May 2017. Prior to joining the NBS, he spent three years at the Dickson Poon School of Law at King’s College London, where he completed his Doctoral research investigating approaches to, and challenges in, holding internet intermediaries accountable for infringements of trademark rights. His research was fully funded by the Dickson Poon PhD Scholarship grant. Prior to moving into full-time academia, he worked for over six years as a State Counsel attached to the Attorney General’s Department in Sri Lanka. He holds a Bachelor of Science in the field of information technology from the Curtin University (Australia) and a Master of Laws (with first class honours) from the University of Cambridge (UK). He spent a year in Australia researching on the applicability of Australian laws relating to trademarks and consumer protection, as well as common law tort principles, to the context of trademark infringements committed in the online environment. This research was the basis for his MPhil thesis at the University of Queensland, which was supported by two grants–the International Postgraduate Research and Centennial scholarships.

曹阳

Yang CAO

曹阳，法学博士，教授，知识产权博士后，哈佛大学互联网与社会中心高级访问学者，上海市浦江学者，兼职律师。2017年作为中国代表赴日内瓦参加WIPO和WTO联合举办的第14期全球知识产权教师高级研讨班。现兼任中国科学技术法学会常务理事，复旦大学知识产权研究中心特邀研究员，上海政法学院知识产权研究中心、科技法研究中心负责人。出版专著多部，在 SSCI、CSSCI期刊发表大量论文。主持国家社科基金、国家知识产权局软科学课题多项课题。

Dr Yang Cao is a Professor of Law at Shanghai University of Political Science and Law (SHUPL). He currently works as Director of Technology and Law Center and Intellectual Property Research Center at SHUPL. He also serves as Executive Director of Technology and Law Society of China.

Professor Cao used to be a Berkman Klein Fellow at Harvard University and was selected as the sole participant from China to attend the WTO-WIPO Colloquium for Intellectual Property Teachers at Geneva in 2017.

Professor Cao writes extensively on international intellectual property policy, IP and innovations, IP and Internet and AI regulations. He is the author of seven academic books and dozens of academic papers. He is also a frequent contributor to influential newspapers and magazines in China, including The Paper, Xinhua News and others.

Professor Cao was named as Shanghai Pujiang Scholar and was awarded the Excellent Talent Prize by Technology and Law Society of China.

Irene CALBOLI

Irene Calboli is the professor of Law of Texas A&M University School of Law since 2015. and is the academic fellow of University of Geneva since 2019. Herresearch interests focus on intellectual property, international trade and comparative law.Herexpertise includes advising international organizations and national governments on issues related to legislative reforms and the impact of intellectual property laws oneconomic and cultural development.

陈斌寅

Binyin CHEN

陈斌寅律师，上海邦信阳建中汇律师事务所合伙人、上海律师协会互联网与信息技术业务研究委员会委员。陈律师在诉讼和非诉领域都有丰富的实践积累。曾代理游戏侵权纠纷、网页抄袭及运营纠纷、互联网肖像权案纠纷、网络音乐版权纠纷、地名描述性商标和标志性商标冲突纠纷、以及商标不正当竞争侵权纠纷等争议解决案件。也为多家公司提供网络传播权保护方案企划、知识产权尽职调查、商标库搭建、著作权登记等全面综合的知识产权服务。

徐国建

Guojian XU

徐国建博士系上海邦信阳中建中汇律师事务所创始合伙人，并担任事务所主任。他曾在西南政法大学、武汉大学、瑞士和荷兰学习和进修法律，并于1994年获得德国汉堡大学法学博士学位。

徐律师是国际商事争议解决专家，作为代理人和仲裁员参与过几百件商事纠纷的解决，具有通过诉讼和仲裁解决商事争议非常丰富的实务经验。他曾作为中国代表团成员参与了2005年海牙《选择法院协议公约》，并全程参与2019海牙《承认与执行外国民商事判决公约》的谈判。具有国际公约谈判和起草方面丰富的经验。徐律师目前担任中国国际私法学会副会长、上海市人民政府行政复议委员会委员以及上海政法学院国际法学院特聘院长等职务，并且是中国国际经济贸易仲裁委员会、上海国际仲裁中心、以及上海、杭州、沈阳等仲裁委员会仲裁员。

Dr. Xu Guojian is the distinguished dean of the International Law School of Shanghai University of Political Science and Law and the director of Boss & Young, Attorneys at Law. He studied law in China, Switzerland, the Netherlands and Germany where he received his degree of doctor juris from Hamburg University in 1994. He was a member of the Chinese delegations to negotiate both 2005 Hague Convention on Choice of Court Agreement and 2019 Hague Convention on the Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters. As a practicing lawyer he has advised a number of clients including both Chinese domestic companies and multinational enterprises in international investment and business transactions as well as has participated as counsel or arbitrator in hundreds of cases of settlement of cross boarder commercial disputes.
